Can You Build on Agricultural Land?
Agricultural land in Goa cannot be used for residential or commercial construction without first converting it to Non-Agricultural (NA) status. This conversion is governed by the Goa Land Revenue Code and requires approval from the Collector through the Mamlatdar's office. Not all agricultural land is eligible for conversion โ paddy fields, communidade lands, and plots in eco-sensitive zones face additional restrictions.
The NA Conversion Process
Step 1: Verify the land is eligible for conversion by checking the RP-2021 zone code. Step 2: Obtain Form I & XIV extracts and a site plan from a licensed surveyor. Step 3: Submit the NA application at the Mamlatdar's office with required fees. Step 4: The application is inspected by the Mamlatdar and forwarded to the Collector. Step 5: If approved, the NA order is issued specifying the permitted land use (residential, commercial, or industrial).
Conversion Fees and Timeline
NA conversion charges are calculated based on the Ready Reckoner rate and the area to be converted. Fees typically range from 1% to 3% of the RR value. The official timeline is 90 days, but in practice, the process can take 6-18 months depending on the complexity and completeness of your application. Engaging a local lawyer who handles land matters regularly can significantly expedite the process.
Paddy Field Restrictions
Paddy fields (locally called 'khazan' lands) have special protection under Goa law. The Agricultural Tenancy Act restricts the conversion and sale of paddy lands, and even the Collector has limited powers to permit conversion. If you're considering a plot that includes or borders paddy land, exercise extreme caution. Verify the Form I entries carefully โ paddy classification is recorded in the land records and is very difficult to change.
Risks of Buying Without NA
Purchasing agricultural land without NA conversion and building on it is illegal and carries serious consequences: the construction can be demolished, penalties imposed, and you may face criminal proceedings. Additionally, banks will not provide loans for properties built on unconverted agricultural land, and resale becomes extremely difficult. Always ensure NA conversion is completed before making any payment.
