Boundary Disputes

Boundary disputes are the most common property conflicts in Goa, especially with older properties where original survey markers have been lost or moved. Resolving boundary disputes requires engaging a licensed surveyor to re-establish boundaries based on original survey records. If the dispute cannot be resolved amicably, it may need to go before the Mamlatdar or a civil court. Prevent these issues by conducting a survey at the time of purchase and documenting boundaries clearly.

Title Conflicts

Title conflicts arise when multiple parties claim ownership of the same property. In Goa, this is especially common with ancestral properties where succession under the Portuguese Civil Code creates complex ownership structures. Disputes may also arise from: conflicting sale deeds, unregistered agreements, verbal promises of sale, and forgery. Resolving title conflicts typically requires civil court proceedings, which can take years. Thorough title verification before purchase is the best preventive measure.

Encroachment Issues

Encroachment occurs when someone occupies or builds on land they don't own. In Goa, encroachments on vacant land are common, particularly on absentee owners' properties. Legal remedies include filing a complaint with the local Panchayat, seeking a court order for eviction, and in some cases, approaching the Collector's office. Prevention is better than cure: fence your property, maintain regular physical checks, and keep property tax payments current to establish active ownership.

Co-Ownership Disputes

When property is jointly owned by multiple family members, disputes over use, sale, or development are common. The Indian Partition Act allows any co-owner to seek judicial partition of jointly-held property. In Goa, the Portuguese Civil Code provisions on joint ownership may also apply in certain cases. For families with jointly-held property, executing a family settlement deed that clearly defines each member's share and rights can prevent future disputes.
